Our Terms and Conditions (Terms), along with our Privacy Policy, provide information about us and the legal terms and conditions on which we sell goods and services to you.
Our Terms, together with our Privacy Policy, govern the use of our Website and any contract between us for the sale of Products to you. By accessing this Website and/or placing an order, you agree to be bound by these Terms. Using this Website indicates that you accept our Terms regardless of whether or not you choose to register with us or order from us.
Our Terms may be amended from time to time. Our Terms were most recently updated on 4th April 2016.
Our Products
The images of the Products on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from images displayed.
We reserve the right to brand all of our Personalised Products.
We may, from time to time, wish to display some of our client design work on our website and reserve the right to do so.
General Terms and conditions
In a nutshell:
- You must be over 18 if you wish to place an order with us.
- We design individually and according to your instruction.
- Payment is due before commencement of label design work.
- Upon receipt of your instruction and payment received, we undertake to commence label design work on your behalf.
- We undertake to provide proofs for your authorisation via email.
- Upon authorisation of proof by yourself via email correspondence or other recognised form of communication, we will print labels, apply and gift pack and dispatch, in accordance with your instructions.
Delivery Policy
In a nutshell:
- We deliver throughout the UK mainland and to certain parts of mainland Europe and beyond.
- For deliveries to remote areas and those not on UK mainland, delivery charges will be quoted separately.
- We will inform you at all times of your scheduled dispatch.
- The price of a Product may or may not include delivery charges, subject to individual agreement. See below our standard delivery rates :
- Standard delivery on 1 to 5 bottles is £7.99 including VAT
- Standard delivery for 6 bottles and over is FREE.
- Multiple delivery points will be charged at £7.99 including VAT per delivery point.
Cancellation, Returns & Refunds Policies
In a nutshell:
- If your order goes missing or arrives damaged, you must inform us immediately. We’ll take full responsibility and replace your order as quickly as we can.
- If you believe your product is faulty, you must return it to us within 7 days. Upon receipt, we will inspect the goods for faults.
- If you have cause to cancel your order once our design work has commenced, we reserve the right to withhold a cancellation fee up to a maximum of 100% of the order value.
- Once production of your order is complete, your order is 100% non-cancellable and non-refundable.
- Please note that we cannot refund you if you simply don’t like it.
Our Policy
- We cannot sell to anyone who is under the age of 18. By placing an order with Hannibal Brown Personalised Wine Design, you are confirming that you are at least 18 years old.
- Our design work is undertaken faithfully to your instruction and every effort will be made to ensure your full satisfaction. We will provide proof of design work for your authorisation via email. Once instruction and payment have been received by us, your order is binding.
- If you have cause to cancel your order once our design work has commenced, we reserve the right to withhold a cancellation fee up to a maximum of 100% of the order value.
- Once production of your order is complete, your order is 100% non-cancellable and non-refundable.
- We will notify you of your intended delivery schedule at all times.
- You will be asked to provide delivery instructions when you place your order. This will be compulsory because we want you to get your order the first time we try to deliver.
- If we are unable to completely fulfil your order with the wine of your choice, we will contact you to inform you of our suggested substitute items of the same value or more. You will have the choice of accepting the substitute or waiting for replacement stock to arrive.
- If we are unable to send replacement goods within 7 days we will inform you of a revised date.
- If our drivers are in any doubt about the age of the recipient on delivery, they will request a form of ID. If the recipient is unable to produce appropriate ID, our drivers will be unable to leave the wine.
- We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
Refund Policy
- Your order is personalised according to your instruction and agreement and is non-cancellable and non-refundable, unless:
- If you have cause to believe that your wine is spoiled or out of condition then you must inform us immediately. You may choose either to return the whole case or just the affected bottles and you must inform us that you will be returning items via email, phone or post. If you choose to return the remainder of the case contents (the same wine), the contents of the case must be unopened and undamaged and we will exchange your goods immediately. The return must be within 30 days of the delivery of your order and should be addressed to : Hannibal Brown Wine Services Ltd, 42 Watery Lane, London, SW20 9AD.
- We will endeavour to replace all faulty goods within 15 days of return.
If we have cause to believe that your wine has been stored inappropriately, we may not be able to offer a refund.
Our Liability
If we fail to comply with our Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of our Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.
We only supply Products for domestic and private use. By entering into this Contract, you agree not to use the Product for any commercial, business or resale purposes, and acknowledge that we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
General
We endeavour to ensure that the information on our Website is correct. We make adjustments from time to time without notification. Our Terms were most recently updated on 4th April 2016.
Nothing in these Terms and Conditions reduces any of your statutory rights. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen’s Advice Bureau.
These Terms and Conditions are applied in accordance with UK law.
Copyright
Upon placing your order with Hannibal Brown Personalised Wine Design, you are confirming that you have permission to use all imagery as supplied by yourself for the purposes of personalisation. Hannibal Brown Personalised Wine Design will not be liable for royalties or any other costs associated with imagery provided by you.
Reproduction of part or all of the contents of this website is prohibited. No part of this website may be copied, stored in a retrieval system, or transmitted in any form or by any means without the prior written permission of Hannibal Brown Wine Services Ltd. Exceptions are made for use of materials where downloads or embed codes are clearly stated, which may be used for non-commercial purposes.
Private & Corporate Wine Tastings
Private Bookings
When confirming a wine tasting event via email, phone or post, Hannibal Brown Wines will require a non-refundable deposit of £100.00 + VAT. Payment is required within 10 days of the booking being made.
The balance of the agreed fee is payable 7 working days before the day of the event.
Should the booking be cancelled within 10 working days of the event being held, then Hannibal Brown will retain the deposit, which can be used against a future tasting if re-booked within 3 months.
In the event that the booking is cancelled within 3 working days or less of the event date, then Hannibal Brown Wines will invoice 75% of the agreed fee.
- If your wine tasting event has been offered as a gift by a third party, or has been won through one of the many charities and good causes that we support, then the event is redeemable no later than 6 months from date of receipt.
Corporate Bookings
When confirming a booking, Hannibal Brown Wines will require a non-refundable deposit of £100 + VAT, or 25% of the total fee, whichever is the greater. Payment is required within 10 days of the booking being made.
The balance of the agreed fee is payable 7 working days before the day of the event.
Should the booking be cancelled within 10 working days of the event being hold, then Hannibal Brown will retain the deposit, which can be used against a future tasting if re-booked within 3 months.
In the event that the booking is cancelled within 3 working days or less of the event date, then Hannibal Brown will invoice 75% of the agreed fee.
